Conscious of the importance of ensuring the protection of personal data, the ChapsVision company and all the entities that make up the group (collectively “ChapsVision” in the rest of the document) make strong commitments to the protection of personal data.

ChapsVision undertakes that the collection and processing of said personal data, carried out from its website and/or in the context of the use of ChapsVision group solutions by customers, will be carried out in accordance with the General Data Protection Regulation (GDPR) and any applicable local privacy laws.

This policy provides you with information on how your personal data is processed by ChapsVision.

ChapsVision may amend this privacy policy from time to time, to take account of legislative and regulatory developments, and any changes in ChapsVision’s organization.

  1. CHAPSVISION’s commitments
 

In general, ChapsVision undertakes to comply with the applicable regulations for all processing of personal data that it carries out. ChapsVision undertakes to comply with the following principles:

– ChapsVision processes your personal data in a lawful, fair and transparent manner ;

– ChapsVision collects your personal data for specific, explicit and legitimate purposes and will not process them in a way incompatible with these purposes ;

– ChapsVision ensures that the personal data processed is adequate, relevant and limited to what is necessary for the purposes for which it is processed ;

– ChapsVision will process your personal data in such a way as to guarantee an appropriate level of security for such data ;

– Each processing operation will be carried out taking into account the principles of data protection, in order to comply with the principle of data protection by design ;

– Personal data processed by ChapsVision is stored either in our databases or in those of our service providers. The hosting servers on which ChapsVision processes data are exclusively located in the European Economic Area. If, for technical reasons, the processing of personal data involves transfers outside the European Economic Area, this will only take place in the presence of an adequacy decision from the European Commission or other legal tools providing you with appropriate guarantees ;

– Data recipients: authorised persons within ChapsVision and, in some cases, its sub-contractors (our “trusted service providers”), may access your personal data. ChapsVision ensures that the number of such persons remains as limited as possible and maintains the confidentiality and security of your personal data.

ChapsVision only provides its trusted service providers with the information they need to provide the service and asks them not to use your personal data for any other purpose. ChapsVision always makes its best efforts to ensure that all trusted service providers with whom it works maintain the confidentiality and security of your data. ChapsVision also ensures that when its relationship with a trusted service provider comes to an end, that service provider deletes your personal data. ChapsVision may ask its trusted service providers to provide a service that requires the processing of your personal data, for example in the following cases:

ChapsVision, when acting as data controller, is responsible for the personal data you provide.

Each form you fill in limits the collection of personal data to what is strictly necessary, and describes :

– the purposes for which the data is collected ;

– whether this data is obligatory or optional for the management of your request ;

– who will be able to access it ;

– your “Data Protection” rights and how to exercise them with ChapsVision.

The personal information collected by means of our forms (contact, downloading of documents, etc.) is intended solely for ChapsVision and its trusted service providers where applicable; it will not be communicated to third parties other than for the sole purpose of management or to meet legal and regulatory obligations.

The personal data collected by ChapsVision are processed according to secure protocols. ChapsVision takes all appropriate measures to protect the confidentiality of your personal data. However, ChapsVision cannot guarantee the confidentiality of messages that you may send via an open telecommunications network.

As a group, the personal data collected may be accessible by each entity belonging to ChapsVision, in accordance with the RGPD.

The personal data that ChapsVision may collect as data controller under this Privacy Policy may include:

– Identification data, such as your full name, address, telephone number, email address ;

– Application data if you wish to apply for a job at ChapsVision, such as your CV, your qualifications and your professional experience ;

– Professional data, such as your diplomas and skills, contact number and professional email, and functions, if you are a supplier, service provider or partner of ChapsVision.

ChapsVision processes personal data for explicit, legitimate and specific purposes. For example, your personal data may be processed for the following purposes:

– the canvassing, on the legal basis of the legitimate interest pursued by ChapsVision to increase its customer base and to target new commercial opportunities ;

– the organisation of, registration for and invitation to ChapsVision events on the basis of the legitimate interest pursued by ChapsVision in building customer loyalty and offering suitable content ;

– the management of suppliers, partners and customers and in particular to ensure the follow-up of the commercial relationship with the latter, the processing of any complaints and the provision of the services requested), insofar as this processing is necessary for the performance of a contract ;

– compliance with legal obligations, in particular accounting or tax obligations, such processing being based on ChapsVision’s compliance with its legal obligations ;

– the management of your application if you apply for a position with ChapsVision, insofar as this processing is necessary for the performance of a contract or to take measures at your request before entering into a contract with us, or because of our legitimate interest in evaluating candidates when we carry out verification procedures.

– To send you newsletters to which you may have subscribed, based on the consent you give to ChapsVision to process your personal data for these purposes.

The personal data collected is kept for the period necessary to achieve the purpose for which it was collected:
Customer relationship management: 5 years from the end of the customer relationship ;
Organisation of, registration for and invitation to ChapsVision events: 3 years from the end of the relationship with the data subject if he or she is a customer and 3 years from the last contact if the data subject is a prospect ;
Management and monitoring of contractual relations: 5 years from the end of the relationship with the customer ;
Debt recovery: until full recovery of the debt or 5 years from the end of the relationship with the debtor ;
– Prevention of money laundering and the financing of terrorism and the fight against corruption: until the legal or regulatory obligation incumbent on us has been met ;
Invoicing: 10 years from the end of the accounting period concerned ;
Accounting: 10 years from the end of the relevant financial year ;
Management of job applications: 2 years from the last contact with the candidate ;
Sending our newsletter: for the duration of the newsletter subscription ;
Management of relationships with service providers and suppliers: 5 years from the end of the relationship ;
Responding to requests made via the website contact form: the period necessary to respond to the request in question.
The ChapsVision website contains links to social networks (Facebook, LinkedIn, Twitter). In this respect, ChapsVision may collect and use the personal data of members of the social network concerned who have registered as members, friends or followers, to contact them on the social network used and/or to send them information. Members of the social network concerned may oppose such use at any time by contacting the contact point below.
ChapsVision informs you that you have the right to access, rectify, port, delete or limit the processing of your personal data. You also have the right to object, on legitimate grounds, to the processing of your personal data and may withdraw your consent at any time and without justification when processing is based on it.
You also have the right to define directives concerning the fate of your Personal Data after your death (Law for a Digital Republic). All requests will be analysed by ChapsVision and must be made in writing, signed by the person making the request, include the address to which the reply should be sent and be accompanied by proof of identity. In case of doubt, ChapsVision may ask you for a copy of your identity card signed by you.
If, for any reason whatsoever, you feel that ChapsVision’s response is not satisfactory, you may lodge a complaint with a supervisory authority.

SPECIFIC INFORMATION RELATING TO OUR ARTIFICIAL INTELLIGENCE SOLUTIONS FOR VIDEO SURVEILLANCE 
 
ChapsVision develops for its professional customers software solutions using artificial intelligence techniques and allowing the analysis of images and videos in a video surveillance context.
Please note: the purpose of this section is to provide you with additional information about how ChapsVision processes your personal data in the development of these solutions. This section is in addition to the other information in this Privacy Policy, which remains in full force and effect. If there is a conflict between anything in this section and the rest of this Privacy Policy, the material in this section will prevail.
Types of personal data collected 
ChapsVision collects images and video sequences of people from several sources:
– Open databases of images of people, such as COCO, Crowd Human and OID. These datasets come from freely accessible sources such as Google Images (OID and CrowdHuman) and Flickr (COCO).
– Data provided by our business customers in the context of their use of our software solutions, in accordance with the contracts binding us to them.
Legal basis for collecting personal data
ChapsVision processes your personal data on the basis of its legitimate interest in developing and improving its video surveillance software solutions. These solutions, in order to be effective and representative of the real world, require the processing of a large volume of data.
You may object to the processing of your personal data in accordance with our privacy policy.
Insofar as we are unable to link the use we make of image data to persons precisely identified using your first and last names alone, we may ask you for additional information to enable you to exercise your right to object. For example, we may ask you for a photograph of yourself that you think ChapsVision will process. We will then compare it with our database and undertake to stop any processing of that photograph should we find such a match.
The purpose of processing personal data
We collect your data to build and maintain our artificial intelligence systems to identify typical scenarios that may be of interest in a video surveillance setting. For example, we may identify “a man who has fallen to the ground” or “a crowd movement”. Our technologies are not used to identify individual people.
Once we have collected images from the various sources mentioned above, we add descriptions (“annotations”) to them to enable the algorithms to understand the meaning of the images they see, and to enable them to detect similar situations in real use cases when our customers use our solutions.
We do not process sensitive personal data, which would have the effect, for example, of targeting categories of people on the basis of their skin colour. We do not annotate the identity, gender, age or ethnicity of people in the images.
We also minimise the data we collect and process wherever possible. We sort through the images collected to retain only the image data relevant to the situations we wish to study.
The personal data we collect is not shared with third parties, except to other companies in the context of a restructuring of our company, such as a merger or transfer of assets.
Retention period for personal data
ChapsVision processes your personal data for as long as is necessary to fulfil the purposes set out above, while respecting the principle of data minimisation.
For any new personal data collected, we store this data on secure servers accessible only to our authorised engineers in commonly used databases for as long as is necessary for the creation and training phase of our algorithmic models. During this phase, we collect data, select subsets of images relevant to our AI software solutions and annotate them.
Data that is of no interest from the point of view of the purposes is deleted within two months of being collected. The remaining data is stored in a separate, secure database to enable us to maintain and improve our AI software solutions in the future. Images in this database that are no longer used within 5 years are deleted.
CHAPSVISION’S COMMITMENTS AS A SUBCONTRACTOR
 
ChapsVision, in its capacity as a software publisher, offers to its customers several services in On Premise or SAAS mode through which said customers collect, analyse, share or process your personal data through our solutions and services.
Within the framework of the use of the solutions, ChapsVision is likely to act on instructions of the customer as a subcontractor, on the basis of the contract signed between ChapsVision and its customer, within the framework of a B-to-B commercial relationship. The ChapsVision customers concerned are the data controllers of your personal data.
In the context of the use of the ChapsVision solutions, the ChapsVision customer may ask us to process your personal data for the following purposes:
Customer Engagement / Fraud & Compliance: to collect, enrich and explore a set of data, to manage customer relations and to steer and implement commercial strategy.
Market Intelligence / Translation: strategic, technological and regulatory intelligence
Unified commerce (retail client engagement): personalising the purchasing path taken by consumers; orchestrating, updating and storing orders and customers with the aim of processing the order from creation to delivery to the customer; creating and consulting a brand’s customers from a tablet, unified collection and payment.
Forensics: digital investigations (legal expertise, assistance with legal requisitions, private IT expertise)
Cybersecurity / Security / Crisis management: audits, engineering and integration of secure systems
Speech to Text: speech-to-text transcription and voice commands.
Judicial: monitoring, collection and processing of judicial and administrative interception data.
Intelligence/Defense/International: collection and analysis of data from the Web, assessment of a person’s digital footprint and identification of cyber risks, collection of data by a system for intercepting mobile phones.

The following personal data may be collected for these purposes:

Market Intelligence / Translation: surname, first name, email address, any personal data held by the data controller

Unified commerce (retail client engagement): surname, first name, email address, postal address, telephone number, screenshot, etc.

Forensics: any personal data held by the data controller

Cybersecurity / Security / Crisis management: any personal data held by the data controller

Speech to Text: surname, first name, email address, telephone number

Judicial interception: all personal data available to data controllers.

Intelligence / Defense / International: any personal data held by the data controller.

The processing operations entrusted to ChapsVision by the data controller may be as follows: collection, hosting, storage, maintenance, support, recording, access, communication by transmission, deletion and destruction.

The data collected is processed by ChapsVision in the European Economic Area, or in countries offering an adequate level of protection, or within the framework of the implementation of appropriate guarantees and is secure.
